1. What SwapGun is
SwapGun is an interface that queries and displays crypto-asset swap quotes offered by third-party providers ("Providers"). SwapGun is not a broker, exchange, financial institution or virtual asset service provider, and it does not execute, intermediate the settlement of, or hold in custody any transaction.
2. Who executes the swap
When you create a swap, you contract directly with the Provider indicated in the offer you chose. The deposit address, execution, payout, any refunds and identity verification are the sole responsibility of the Provider, under its own terms and policies, which you should read before sending funds.
3. Quotes and fees
- The amounts shown are estimates provided by the Providers and may change until execution, especially with floating rates.
- Fixed rates are valid for the period set by the Provider. Deposits outside that period or the limits may be recalculated or refunded.
- The network fee charged by your wallet when sending is not included in the estimates.
- SwapGun may receive a commission from Providers for completed swaps and, if it applies its own fee on top of the quote, it will disclose it before you confirm.
4. Your responsibilities
- Provide correct addresses compatible with the selected currency and network, including the memo or tag when required.
- Send exactly the currency, network and amount indicated. Blockchain transactions are irreversible.
- Comply with applicable law, including tax obligations and crypto-asset reporting requirements.
- Do not use the service for unlawful activities, including money laundering and terrorist financing.
5. Risks
Crypto-assets are volatile and can lose value quickly. Errors in the address, network or memo can cause permanent loss. Providers may delay, suspend or refuse transactions, including because of compliance requirements. You assume these risks when you use the service.
6. Limitation of liability
To the fullest extent permitted by law, SwapGun is not liable for losses arising from acts or omissions of the Providers, market movements, blockchain network failures, user input errors or third-party unavailability. Nothing in these terms excludes rights guaranteed by the Brazilian Consumer Defense Code (Código de Defesa do Consumidor) where applicable.
7. Restrictions
Providers may restrict service to certain countries or persons. Do not use the service where it is prohibited for you.
8. Changes and contact
These terms may change, and the update date indicates the version in force. Questions: bluratech@gmail.com. See also the Privacy Policy.
9. Governing law and venue
Brazilian law applies. [Competent venue to be defined during legal review.]
